Allgemeine Geschäftsbedingungen der we gmbh
Die we gmbh (im Nachfolgenden kurz „We“ genannt) schließt Verträge ausschließlich zu den nachfolgenden Allgemeinen Geschäftsbedingungen:
1. Vertragspartner/Art der Dienstleistung
1.1. We bietet Gästen die Beherbergung gegen Entgelt. Bei den von We angebotenen Leistungen handelt es sich also um Beherbergungsverträge.
1.2. „Gast“: Ist eine natürliche Person, die Beherbergung in Anspruch nimmt. Der Gast ist zugleich Vertragspartner.
2. Vertragsabschluss
2.1. Der Gast stellt eine Buchungsanfrage an We, wobei dies per Email, online über we-rent-apartments.com oder über andere Webseiten (einschließlich booking.com usw.) erfolgen kann. Die Buchung wird in jedem Fall durch Zusendung einer Reservierungsbestätigung und Aufforderung zur Leistung einer Anzahlung bestätigt. Der Beherbergungsvertrag gelten mit Zusendung der Reservierungsbestätigung als abgeschlossen.
2.2. Der Beherbergungsvertrag wird jedoch unter der Bedingung geschlossen, dass innerhalb von fünf Werktagen eine Anzahlung in der Höhe laut Buchung (Bezahlung über Kreditkarte oder Überweisung) geleistet wird. Erfolgt die Anzahlung nicht, ist die Bedingung nicht erfüllt, und der Vertrag ist nicht rechtswirksam. Die Anzahlung ist Teilzahlung auf das vereinbarte Entgelt.
3. Stornierungen
3.1. Liegen zwischen der Reservierungsbestätigung und dem vereinbarten Anreisedatum bei der Buchung einer einzelnen Ferienwohnung mehr als 14 Tage, kann der Gast die Buchung kostenfrei stornieren.
Bei der Buchung eines gesamten Chalets ist eine kostenfreie Stornierung möglich, sofern zwischen der Reservierungsbestätigung und dem vereinbarten Anreisedatum mehr als 30 Tage liegen. Die 30-Tage-Frist gilt ebenfalls für Gruppenbuchungen ab 10 Personen sowie für Buchungen von drei oder mehr Wohnungen.
Erfolgt die Stornierung innerhalb der jeweils genannten Frist vor dem Anreisedatum, ist eine kostenfreie Stornierung nicht mehr möglich. In diesem Fall wird das vereinbarte Entgelt in voller Höhe fällig.
3.2. Das Konsumentenschutzgesetz und das Fernabsatzgesetz sind anwendbar.
4. Preise
4.1. Die ausgewiesenen Preise sind Tagespreise für die Miete der gebuchten Unterkunft (samt Mobiliar), wobei der Verbrauch an Wasser, Energie etc. inkludiert ist. Der erste Tag reicht von 16:00 Uhr des Anreisetages bis 10:00 Uhr des Folgetages; jeder weitere Tag reicht immer bis 10:00 Uhr des Folgetages. Sämtliche zwingenden Nebenleistungen, welche nicht im Tagespreis enthalten sind – wie z.B. Endreinigung und Ortstaxe –, werden in der Reservierungsbestätigung ausdrücklich angegeben.
4.2. Nicht zwingende, vom Kunden gewünschte und allenfalls von We angebotene Nebenleistungen – wie z.B. zusätzliche Reinigung, zusätzliche Bettwäsche, Haustiere, Babybetten, Heizmaterial usw. – sind im Tagespreis nicht enthalten, aber auch in der Reservierungsbestätigung nicht angeführt.
5. Leistungs- und Preisänderungen
5.1. Auf Grund zwingender äußeren Umstände oder höherer Gewalt können von Seiten der We Preis- oder Leistungsänderungen auftreten. Wenn aufgrund zwingender äußerer Umstände oder höherer Gewalt nach Vertragsabschluss Preis- oder Leistungsänderungen, die nicht bloß geringfügig sind, auftreten, kann der Gast binnen drei Tagen nach Erhalt der Mitteilung kostenlos vom Vertrag zurückzutreten. Bereits erfolgte Zahlungen werden umgehend rückvergütet. „Nicht bloß geringfügig“ meint den Wegfall eines spezifischen Details welches gerade das betreffende Objekt von anderen abhebt und gerade dadurch für den Gast interessant macht. Zugangsbeschränkungen sind davon jedoch ausdrücklich ausgenommen.
5.2. Die Korrektur von offensichtlichen Irrtümern, z.B. aufgrund von Druck- und Rechenfehlern, bleibt vorbehalten.
6. An- und Abreise, Verkürzung oder Verlängerung des Aufenthaltes
6.1. Die Anreise muss nach 16:00 Uhr am Anreisetag, die Abreise bis spätestens 10 Uhr des Abreisetags erfolgen. Änderungen (z.B. spätere An- oder Abreise, Aufenthaltsverlängerungen oder -verkürzungen) sind nur im Einvernehmen mit der We möglich. Ohne Herstellung des Einvernehmens mit der We wird jedenfalls der gesamte Preis laut Buchung fällig, selbst wenn der Gast die vertraglichen Leistungen wegen Krankheit, Stau oder aus anderen, nicht von We zu vertretenden Gründen nicht oder nicht vollständig in Anspruch nimmt.
6.2. Für die Einhaltung der Pass-, Visa-, Zoll-, Devisen- und Gesundheitsbestimmungen ist der Gast selbst verantwortlich. Eine Verhinderung der Anreise aus solchen Gründen berechtigen den Gast nicht, Rechtsfolgen daraus abzuleiten.
6.3. We ist täglich bis 20:00 Uhr telefonisch erreichbar. Im Fall von späteren Anreisen ist eine telefonische Kontaktaufnahmemöglichkeit nicht gesichert.
7. Auflösung des Vertrages durch We
We ist berechtigt, den Vertrag im Falle höherer Gewalt, Pandemie, Krieg, Streik oder ähnlichen wichtigen Gründen aufzulösen. Sämtliche geleisteten Zahlungen werden dem Gast in diesem Fall in voller Höhe zurückerstattet.
8. Pflichten des Gastes
8.1. Vor Übernahme der Schlüssel bzw. Zugangscodes ist eine Kaution in Höhe von EUR 400 (Ferienwohnungen) und EUR 800 für Chalets zu hinterlegen. Bei Abreise wird dem Gast – nach Abzug allfälliger Kosten bei berechtigten Forderungen seitens We – die Kaution binnen 48 Stunden zurückerstattet. Dieser Zeitraum versteht sich exklusive der Bearbeitungszeit der Bank des Kunden.
8.2. Die Unterkunft darf nur mit der vorgesehenen Anzahl Personen belegt werden (Kinder und Babys inbegriffen). Zusätzliche Personen können von We abgewiesen oder gesondert verrechnet werden.
8.3. Die Unterkunft und deren sämtliche Einrichtungen sind sorgfältig zu gebrauchen. Der Gast verpflichtet sich, Rücksicht auf Nachbarn und andere Gäste zu nehmen. Die Reinigung der Kücheneinrichtungen, des Geschirrs und Bestecks ist Sache des Gastes (und nicht in der Endreinigung inbegriffen).
8.4. Der Gast haftet We gegenüber für jeden Schaden, den er oder sonstige Personen, die mit Wissen oder Willen des Gastes Leistungen von We entgegennehmen, schuldhaft verursachen. Wird im Sinne des vorherigen Satzes ein Schaden verursacht, ist dieser unverzüglich an We zu melden.
9. Beanstandungen, Schadenersatz
9.1. Auskünfte und Beschreibungen werden von We nach bestem Wissen und Gewissen, jedoch ohne Garantie für die Richtigkeit angegeben. Bei Reklamationen hat sich der Gast direkt an We zu wenden. Der Mangel bzw. die Beanstandung ist unverzüglich zu melden. Spätere Reklamationen, die erst bei Abreise bzw. nach erfolgter Abreise eintreffen, können nicht mehr entgegengenommen werden.
9.2. Sollte die Unterkunft nicht vertragskonform sein, ist We bemüht, dem Gast ein gleichwertiges Ersatzobjekt zur Verfügung zu stellen. Ist dies innerhalb einer Frist von 5 Werktagen nicht möglich, so vergütet We dem Gast einen allfälligen Minderwert, wenn schuldhaftes Verhalten vorliegt.
9.3. Ist der Gast ein Konsument, wird die (Schadenersatz-)Haftung der We für leichte Fahrlässigkeit, mit Ausnahme von Personenschäden, ausgeschlossen. Ist der Gast ein Unternehmer, wird die Haftung der We für leichte und grobe Fahrlässigkeit ausgeschlossen.
9.4. Für eingebrachte Sachen haftet We gemäß §§ 970 ff ABGB. Die Haftung ist nur dann gegeben, wenn die Sachen We oder den von We befugten Leuten übergeben oder an einen von diesen angewiesenen oder hiezu bestimmten Ort gebracht worden sind. Sofern We der Beweis nicht gelingt, haftet We für sein eigenes Verschulden oder das Verschulden seiner Leute sowie der aus- und eingehende Personen. We haftet jedoch gemäß § 970 Abs 1 ABGB höchstens bis zu dem im Bundesgesetz vom 16. November 1921 über die Haftung der Gastwirte und anderer Unternehmer in der jeweils geltenden Fassung festgesetzten Betrag. Kommt der Gast der Aufforderung, seine Sachen an einem besonderen Aufbewahrungsort zu hinterlegen nicht unverzüglich nach, ist We aus jeglicher Haftung befreit.
10. Chatbot
We stellt auf seiner Website einen KI-gestützten Chatbot zur Verfügung, der der allgemeinen Information, Unterstützung und Kommunikation mit Nutzern dient. Der Chatbot verarbeitet die vom Nutzer eingegebenen Inhalte automatisiert, um Anfragen zu beantworten und die bereitgestellten Informationen kontextbezogen auszuwerten.
Der Nutzer nimmt zur Kenntnis, dass
Der Nutzer verpflichtet sich, keine sensiblen personenbezogenen Daten (insbesondere Gesundheitsdaten, Daten über strafrechtliche Verurteilungen, Bank- oder Kreditkartendaten) einzugeben, sofern dies nicht ausdrücklich vorgesehen ist.
Mit Nutzung des Chatbots erklärt sich der Nutzer mit der Verarbeitung seiner eingegebenen Daten nach Maßgabe der Datenschutzerklärung einverstanden.
Der Betreiber ist berechtigt, Chatbot-Anfragen zu Analyse- und Verbesserungszwecken anonymisiert oder pseudonymisiert auszuwerten.
11. Internetzugang
In Ferienwohnungen, welche über einen Internetzugang verfügen, wird keine Haftung für die Funktion der Hard und Software übernommen. We weist auch darauf hin, dass keine D-LAN Verbindung besteht und ausschließlich W-Lan angeboten wird.
12. Sonstiges
12.1. Mit Vertragsabschluss wird die Zustimmung zur Datenverarbeitung gegeben. Die komplette Datenschutzerklärung ist unter https://www …. einsehbar.
12.2. Erfüllungsort und Gerichtsstand für alle aus dem Rechtsverhältnis zwischen Gast und We entstehenden Rechtstreitigkeiten ist Zell am See. Sämtliche Rechtsverhältnisse unterliegt ausschließlich den Bestimmungen des Österreichischen Rechts.
